I agree with you in part, so I amended that section so it's less absolute that "all of the $12" from a premium account goes to the artist they listen to exclusively.
Where I disagree is that premium accounts provide more revenue to artists they listen to. The court highlighted this point in the indictment - the defendant used some 10,000 premium accounts to listen to his own music. Had he used only free versions he would have received less revenue.
