Where in the text of section 3 of the 14th amendment do you see anything about presumption of evidence? I think you may actually be referring to the presumption of innocence, which is relevant in a criminal court of law, but for the purposes of this section of the constitution, it’s not relevant at all.
There’s nothing in the text of section 3 that even suggests a conviction is required to disqualify someone from public office.
It’s a far more dangerous precedent to permit someone to hold public office who engaged in insurrection/rebellion, or who assisted and gave comfort to those who did.
