I hear you, but what are your thoughts on John Roberts’s decisions on Obamacare, Trump’s felony convictions in NY, etc.? He hasn’t always sided with the conservative majority, although I’ll admit the abortion and presidential immunity opinions were absurd. I do think he’s at least somewhat conscientious of the court’s longstanding institutional legitimacy based on this history, and I definitely think he fears an executive who thinks he can defy the courts, especially his court. Time will tell of course, but regardless, preemptive measures as detailed in the essay are necessary if America wants any semblance of an independent judiciary.
