Holmes hurt a lot of patients and ordinary people too. Don’t let the verdict fool you. The patient charges were simply harder for the DOJ to prove - more intermediaries involved, tough questions around intent. People received blood tests from Theranos that suggested they were HIV positive or had cancer. The effects these tests had on ordinary people were also a driver for DOJ bringing charges here. Unfortunately they didn’t focus on them as much at trial because they knew the investor charges were more of a slam dunk.
